Terms of service
Terms governing use of UpDeskCRM.
These Terms of Service ("Terms") govern your access to and use of the UpDeskCRM service ("Service"). By signing up or using the Service, you agree to these Terms.
Accounts
Each UpDeskCRM account runs in an isolated workspace. You are responsible for: (a) maintaining the confidentiality of your credentials; (b) all activity under your account; (c) notifying us promptly of any unauthorized access.
Acceptable use
You agree not to: (a) use the Service for illegal purposes or to transmit unlawful material; (b) attempt to gain unauthorized access to any system or data; (c) interfere with the Service or disrupt other users; (d) reverse engineer, decompile, or attempt to derive source code; (e) resell or sublicense the Service without a written agreement.
Subscriptions and billing
UpDeskCRM offers a free tier and paid plans. Paid plans are billed in advance per the billing cycle selected. Prices are in USD or EUR as shown. Taxes are added where applicable. You may upgrade, downgrade, or cancel at any time; changes take effect at the next billing cycle. No refunds for partial periods unless required by law.
Service availability
We target 99.9% monthly uptime for the Service. Scheduled maintenance windows will be communicated in advance. The free tier is provided "as is" without uptime guarantees.
Data ownership
You own all Customer Data you upload or create in the Service. We do not claim ownership. We process Customer Data only to provide the Service, as described in our Data Processing Agreement.
Data isolation
Each account runs in a logically isolated workspace. We implement technical and organizational measures to prevent cross-tenant data access.
Updates and maintenance
We deploy updates, security patches, and feature improvements automatically. You always access the current maintained version.
Integrations
Email integration is included. WhatsApp and VoIP integrations are paid add-ons and subject to separate terms with the respective providers. Availability of any integration is not guaranteed.
Cancellation and data export
You may cancel your account at any time. Upon cancellation, you may request a data export in a standard format. We will delete or anonymize Customer Data within 30 days after contract end, subject to legal retention requirements.
Warranty disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
Governing law
These Terms are governed by the laws of Tunisia. Disputes shall be resolved in the courts of Tunis.
Changes
We may modify these Terms. Continued use after changes constitutes acceptance. Material changes will be notified by email or in the Service.
